DMCA Policy
Effective date: March 1, 2026
FairBrief respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond to notices of alleged copyright infringement that comply with the DMCA and applicable law.
1. Filing a Takedown Notice
If you believe that content hosted on FairBrief infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include:
- A description of the copyrighted work you claim has been infringed.
- The URL or specific location on FairBrief where the allegedly infringing material is located, with enough detail for us to find it.
- Your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
2. How We Respond
Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing content.
- Notify the user who uploaded the content that it has been removed.
- Provide the uploader with information about how to file a counter-notice if they believe the takedown was in error.
3. Counter-Notice Process
If you believe your content was removed by mistake or misidentification, you may file a counter-notice. Your counter-notice must include:
- Identification of the content that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the content was removed as a result of mistake or misidentification.
- Your full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in your district (or San Francisco, California, if you are outside the United States) and that you will accept service of process from the person who submitted the original takedown notice.
- Your physical or electronic signature.
Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the removed content within 10–14 business days, unless the complainant notifies us that they have filed a court action.
4. Repeat Infringer Policy
FairBrief maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. If a user receives multiple valid DMCA takedown notices, their account may be suspended or permanently terminated at our discretion.
5. Designated Agent
All DMCA notices and counter-notices should be sent to our designated agent.
Contact us through the form on our website with the subject "DMCA Takedown Notice" or "DMCA Counter-Notice" and include all required information listed in sections 1 and 3 above.
6. Good Faith Requirement
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorney's fees.
